Knysna Electrician – Terms & Conditions of Trade
Effective Date: 1 April 2025
1. Scope of Work
1.1 Project Definition: The scope of work for each project will be clearly defined in a written contract or proposal, outlining the specific electrical services to be provided, including installation, repair, maintenance, and upgrades.
1.2 Changes to Scope: Any changes or additions to the scope of work must be agreed upon in writing by both parties and will be subject to a revised quotation or contract.
1.3 Third-Party Work: Knysna Electrical is not responsible for the work or delays caused by third-party contractors or suppliers, unless otherwise agreed upon in writing.
1.4 Client Inspection: Clients are responsible for inspecting the work upon completion and notifying Knysna Electrical of any defects or issues within a reasonable timeframe.
1.5 Internet-Dependent Systems: For smart Wi-Fi components, the client is responsible for providing reliable internet connectivity at the point of installation.
1.6 SSEG Applications: Small Scale Embedded Generation applications (e.g. Eskom or municipal) remain the responsibility of the property owner. Assistance may be offered by Knysna Electrical upon request.
1.7 Ownership of Equipment: All goods, including monitoring equipment installed for maintenance purposes, remain the property of Knysna Electrical until paid for in full.
1.8 Municipal Meter Limitations: Knysna Electrical has no jurisdiction or responsibility over municipal or Eskom KWh meters. Staff and clients are not permitted to tamper with these meters under any circumstances.
2. Payment Terms
2.1 Deposit & Balance: An 80% deposit is payable on acceptance of a quote. The balance is due upon completion. Full payment is required before we leave the site, unless prior written arrangements are in place.
2.2 Payment Schedule: All payment terms, including milestones and due dates, will be defined in the service contract.
2.3 Late Payment: A late payment fee of 10% per month will be charged on overdue accounts not settled within 30 days of the due date.
2.4 Payment Methods: Accepted payment methods include EFT, cash, or credit card.
2.5 Retention: No retention amounts may be withheld unless agreed to in writing.
2.6 Cancellation Fee: A 30% cancellation fee applies to all cancellations.
3. Warranties
3.1 Workmanship: All labour is warranted to be of good quality and free from defects for 12 months from the date of completion.
3.2 Manufacturer Support: Knysna Electrical does not warrant products or materials supplied by third parties but will support clients in making manufacturer warranty claims.
3.3 Display Compliance: Compliance Certificates and warranties will be void if safety signage (e.g. dual power source warnings) is not correctly displayed and maintained.
3.4 Warranty Limitations: The warranty does not cover damage caused by misuse, neglect, power surges, environmental factors, or modifications by others.
4. Liability
4.1 General Liability: Liability is limited to the cost of rectifying defects related to workmanship as outlined in the warranty terms.
4.2 Third-Party Claims: Knysna Electrical shall not be held liable for damages caused to third parties or claims resulting from misuse of installed systems.
4.3 Force Majeure: We are not liable for service delays due to events beyond our control, including extreme weather, supply chain disruptions, load shedding, or natural disasters.
4.4 Client Responsibility: Clients must ensure that their properties are adequately insured against accidental damage. While all reasonable care is taken by our technicians, accidental damage is always a risk during technical work.
5. Documentation
5.1 Compliance Certificates: It is the property owner’s responsibility to retain all Electrical Compliance Certificates and test reports. Knysna Electrical does not retain copies for clients.
5.2 Project Documentation: All notices and documentation must be in writing and exchanged via the addresses listed in the official quotation or contract.
6. Legal
6.1 Governing Law: These Terms and Conditions are governed by the laws of the Western Cape, South Africa.
6.2 Entire Agreement: These Terms represent the entire agreement between Knysna Electrical and the client and supersede any prior agreements or discussions.
6.3 Severability: If any clause is found to be invalid or unenforceable, the remaining clauses shall remain in full force and effect.
